Pipe Damage Claims

The water damage caused by plumbing leaks can be disastrous. No matter what the environment or cause, if a pipe breaks in your home it's time to call Attorney Larry Moskowitz and his team of property damage experts at Windy Law because when it comes to water damage of any kind, time is of the essence.

The majority of homes built before 1975 were built using cast iron pipes

And although that may not seem like a long time ago, it means that your house and the pipes that are underneath are a minimum of 46 years old. It's not a matter if your pipes will eventually leak and fail; it's a matter of when.

Here's where it gets complicated, and when things get complex and you need an aggressive attorney to help. Insurance policies are notoriously difficult to read, much less understand. They are filled with fine print.

  • For example, did you know that the insurance company is only required to pay for access to your iron cast pipes and not pay for the actual pipes themselves?

If your insurer agrees to pay for your plumbing leak,  usually they will only agree to pay for the area of your plumbing system where it’s currently leaking.  If you agree to this as a solution to your problem you may have a much bigger problem in the future.  As in most older homes with iron cast pipes,  if there is a current leak in one area most likely the entire plumbing system is failing and must all be replaced. If you fail to replace the entire system the future consequences may be as follows:

Any subsequent leaks will be denied as a prior claim;

When you attempt to buy property damage insurance in the future you may be denied coverage as a result of your prior plumbing claim that was not completely restored

If you sell your home in the future, you will have a legal obligation to disclose a prior property damage pipe leak claim where the total plumbing system was not restored;

If your carrier has not offered to replace all of your plumbing, it’s now time to call one of the most aggressive property damage attorneys.

 You’ve done your part and paid your premiums. Now it's your insurance company’s turn to write the check!
